Terms of Service
These Terms of Service (the “Terms” or “Agreement”) govern your access to and use of the Waymark website, application, and services (collectively, the “Service”), operated by Alex MacArthur (“Waymark,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Acceptance of Terms
By creating an account, accessing the Service, or submitting a question through the ask widget (whether authenticated or as a guest), you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to update or modify these Terms at any time; material changes will be communicated via email or through a prominent notice on the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Description of Service
Waymark provides an AI-powered theological Q&A platform. Users submit questions and receive answers generated by large language models grounded in a curated corpus of Reformed theology texts, creeds, confessions, church fathers, scripture, and hymns. The Service includes:
- An ask widget (available to both authenticated users and guests) for submitting theological questions
- A browseable library of corpus works
- Conversation history and sharing features
- Optional paid subscription tiers for expanded access
Waymark is a tool for theological exploration and study. It is not a substitute for ordained pastoral counsel, formal theological education, or professional religious advice.
3. Eligibility & Accounts
a. Eligibility
You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to create an account or use the Service. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete.
b. Account Responsibilities
- You are solely responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account, whether authorized by you or not.
- You agree to notify us immediately of any unauthorized use of your account.
- You may not share access to a paid subscription account with individuals outside your household.
c. Guest Use
You may use the ask widget without creating an account (as a “guest”). Guest usage is subject to the same Acceptable Use Policy and all other provisions of these Terms. Guest conversations are identified by a random browser token rather than an email address. Guest access is subject to rate limits and feature restrictions at our discretion.
d. Account Termination
We reserve the right to suspend or terminate any account at any time for violation of these Terms, illegal activity, or conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties.
4. Acceptable Use
a. Prohibited Conduct
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party right
- Submit questions or content that is abusive, harassing, defamatory, obscene, or otherwise objectionable
- Attempt to manipulate, bypass, or abuse the Service’s rate limits, authentication mechanisms, or usage restrictions
- Use automated means (bots, scrapers, scripts) to submit questions or access the Service without our express written permission
- Reverse-engineer, decompile, or disassemble any aspect of the Service
- Attempt to access, probe, or scan the Service’s underlying infrastructure, including our AI provider endpoints, databases, or administrative interfaces
- Use the Service to generate content for commercial AI training, model distillation, or dataset creation
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
b. AI-Generated Content
Waymark generates responses using large language models (LLMs) and a curated theological corpus. You acknowledge that:
- AI-generated responses may contain errors, inaccuracies, or hallucinations. They should not be treated as inerrant or infallible statements of doctrine, history, or fact.
- You are responsible for exercising your own judgment and discernment, and for verifying AI-generated content against primary sources and trusted authorities.
- AI-generated content does not constitute professional theological advice, pastoral counseling, or legal opinion.
- We make no guarantee regarding the theological accuracy, orthodoxy, or completeness of any AI-generated response.
c. Public Conversations
Conversations you choose to make public are accessible via a shareable URL, may be indexed by search engines, and may be displayed publicly on the Service. You are solely responsible for the content of conversations you make public. We recommend you do not include personally identifiable information in public conversations.
5. Subscription & Billing
a. Free and Paid Tiers
Waymark offers both free and paid subscription tiers. Free-tier usage is subject to rate limits on the number of questions you may ask within a rolling period. Paid subscriptions provide expanded access as described on our Pricing page. We reserve the right to modify our pricing, subscription tiers, and usage limits at any time with reasonable notice.
b. Payment Processing
All payments are processed securely through Stripe. Waymark does not store, transmit, or have access to your credit card number or other payment instrument details. By subscribing, you authorize Stripe to charge your payment method on the recurring basis specified in your subscription plan.
c. Billing & Cancellation
- Subscriptions are billed in advance on a monthly or annual basis, as selected during checkout.
- You may cancel your subscription at any time from your Account page. Upon cancellation, access to paid features continues until the end of the current billing period. No prorated refunds are provided for partial billing periods.
- Failed payment attempts may result in service suspension. We will make reasonable attempts to notify you before suspending access.
d. Refunds
We do not offer refunds for subscription fees already paid, except as required by applicable law. If you believe you have been charged in error, please contact us within 30 days of the charge.
e. Price Changes
If we change the price of a subscription plan, we will notify you at least 30 days in advance. Continued use of the Service after the price change takes effect constitutes acceptance of the new price. If you do not agree to the new price, you may cancel before the change takes effect.
6. Content Ownership & License
a. User Content
You retain all ownership rights to the questions and content you submit to the Service (“Your Content”). By submitting Your Content, you grant Waymark a worldwide, non-exclusive, royalty-free license to use, reproduce, store, and display Your Content solely for the purpose of operating, providing, and improving the Service. This includes storing your questions and the AI-generated responses as part of your conversation history.
b. Corpus Works
The theological texts, creeds, confessions, and other works in the Waymark corpus are made available for reference and study within the Service. These works are in the public domain, used with permission, or otherwise made available under applicable licenses. You may read and reference these works within the Service, but you may not reproduce, redistribute, or republish substantial portions of the corpus outside the Service without the permission of the respective rights holders.
c. Service Content & Trademarks
The Waymark name, logo, and brand identity are trademarks of Alex MacArthur. The design, layout, and software code of the Service are proprietary and may not be copied, reproduced, or reused without our express written permission, except as explicitly permitted by these Terms.
d. Feedback
If you provide us with suggestions, feature requests, or other feedback regarding the Service, we may use such feedback without any obligation to you.
7. Copyright Infringement (DMCA Notice)
We respect the intellectual property rights of others and expect our users to do the same. If you believe that any material available on or through the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) to our designated agent:

Your DMCA notice must include:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to locate it
- Your contact information (address, telephone number, and email address)
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf
- Your physical or electronic signature
We reserve the right to remove material alleged to be infringing and to terminate accounts of repeat infringers in appropriate circumstances.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYMARK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your specific theological, academic, or pastoral needs
- AI-generated responses will be accurate, complete, reliable, or theologically sound
- The Service will be uninterrupted, timely, secure, or error-free
- Any defects or errors in the Service will be corrected
No advice or information, whether oral or written, obtained from Waymark or through the Service creates any warranty not expressly stated in these Terms.
No Religious or Professional Advice: Waymark is a tool for theological exploration, not a substitute for ordained pastoral ministry, professional counseling, or formal theological education. AI-generated responses do not constitute professional advice of any kind, including but not limited to religious, spiritual, psychological, or legal advice. You should not rely solely on AI-generated content for important spiritual, doctrinal, or life decisions.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAYMARK, ITS OPERATOR, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF—OR INABILITY TO ACCESS OR USE—THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WAYMARK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid us for access to the Service in the twelve (12) months preceding the event giving rise to the liability, or (b) one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Waymark and its operator from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law or regulation
- Your Content, including any claims that Your Content infringes the rights of a third party
- Any dispute between you and another user of the Service
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.
11. Termination
a. Termination by You
You may terminate your account at any time from your Account page. Upon termination, your access to the Service ceases, and your account data will be handled in accordance with our Privacy Policy.
b. Termination by Waymark
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination:
- Your right to access and use the Service immediately ceases
- We may delete your account, conversations, and associated data in accordance with our data retention practices
- Any prepaid subscription fees are forfeited, except as required by applicable law
c. Survival
Sections 6 (Content Ownership & License), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), 13 (Dispute Resolution), and 15 (Contact) shall survive any termination of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Williamson County, Tennessee, and you hereby consent to the personal jurisdiction of such courts.
13. Dispute Resolution
a. Informal Resolution
Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at macarthur.me/contact. We will make reasonable efforts to resolve the dispute within 30 days. If the dispute is not resolved within that period, either party may pursue formal resolution.
b. Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WAYMARK AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If a court or arbitrator determines that this class action waiver is void or unenforceable for any reason, the agreement to arbitrate (if applicable) shall be deemed void with respect to that dispute.
c. Injunctive Relief
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to address an actual or threatened violation of these Terms.
14. General Provisions
a. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waymark regarding your use of the Service, superseding any prior agreements or understandings.
b. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
c. Waiver
No failure or delay by Waymark in exercising any right under these Terms shall operate as a waiver of that right. No single or partial exercise of any right shall preclude any other or further exercise of that right.
d. Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely without notice or consent.
e. Force Majeure
Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, strikes, internet service disruptions, and governmental action.
f. Electronic Communications
By using the Service, you consent to receive electronic communications from us (including notices, disclosures, and transactional messages). You agree that such electronic communications satisfy any legal requirement that communications be in writing.
15. Changes to These Terms
We may revise these Terms from time to time. Material changes will be communicated at least 30 days before they take effect, either by email (for users with accounts) or by posting a prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription (if applicable) before the changes take effect. The current version of these Terms will always be available at https://waymark.on-forge.com/terms.
